1. Introduction and Acceptance of Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between Milestones Academy of Texas (“the Academy,” “we,” “us,” or “our”), located at 1740 FM 544, Lewisville, TX 75056, and the parent(s) or legal guardian(s) (“Parent,” “Guardian,” or “you”) enrolling a child (“Child” or “Enrollee”) in any of the Academy’s programs, services, camps, or activities. 

By submitting an enrollment form, registration fee, or allowing your child to attend any Academy program, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you should not enroll your child and should contact us immediately to discuss your concerns. 

These Terms apply to all programs offered by the Academy, including but not limited to: Infant Care, Toddler, Pre-School, Early Pre-K, Pre-K, After School Care, Summer Camp, Winter Camp, and any other seasonal or specialty programs. 

2. Enrollment and Admissions

2.1 Eligibility 

The Academy enrolls children from six (6) weeks to five (5) years of age in its core programs. The After School Care program serves elementary-age children. Summer Camp and Winter Camp are open to children from rising Pre-K through 5th grade. Enrollment is subject to availability and the Academy’s sole discretion. 

2.2 Required Documentation 

Enrollment is not considered complete, and a child may not attend, until the following documents are received and approved: 

  • Completed and signed enrollment form 
  • Current immunization records in compliance with Texas state requirements 
  • Emergency contact information (minimum two contacts) 
  • Signed physician statement 
  • Any applicable allergy or medical care plan 
  • Payment of the annual registration fee 

2.3 Registration Fee 

A non-refundable annual registration fee of $250.00 is required upon enrollment and upon each annual renewal. This fee reserves the child’s spot and covers administrative processing. It is not applied toward tuition. 

2.4 Waitlist 

If enrollment capacity has been reached, families may be placed on a waitlist. Placement on a waitlist does not guarantee enrollment and does not create any obligation on the part of the Academy. Families will be contacted in order of waitlist placement as space becomes available. 

2.5 Enrollment Confirmation 

Enrollment is confirmed only upon receipt of all required documentation, the registration fee, and written confirmation from Academy administration. The Academy reserves the right to decline enrollment at its discretion. 

3. Tuition, Fees, and Payment

3.1 Tuition Rates 

Tuition rates vary by program, age group, and schedule selected. Current rates are provided by the Academy’s admissions team upon inquiry and are subject to change. Families will be given a minimum of 30 days’ written notice of any tuition increase. 

3.2 Payment Schedule 

Tuition is due on the first business day of each month. Payments not received by the 5th of the month will be considered late. 

3.3 Late Payment 

A late fee of $25.00 will be assessed for any payment received after the 5th of the month. If tuition remains unpaid after the 15th of the month, the Academy reserves the right to suspend the child’s enrollment until the account is brought current. Repeated late payments may result in termination of enrollment. 

3.4 Returned Payments 

A fee of $35.00 will be charged for any returned check or declined electronic payment. After two returned payments, the Academy may require payment by cashier’s check, money order, or cash only. 

3.5 Accepted Payment Methods 

The Academy accepts payment by check, electronic bank transfer, or other methods as communicated by administration. Cash payments must be accompanied by a written receipt. 

3.6 No Tuition Credits for Absences 

Tuition is charged on a monthly basis to hold the child’s enrolled spot. No credits, refunds, or reductions in tuition will be granted for absences due to illness, vacation, holidays, or any other reason unless the Academy is closed due to an emergency or administrative closure of five (5) or more consecutive business days. 

3.7 Summer Camp and Seasonal Program Fees 

Tuition for Summer Camp, Winter Camp, and any other seasonal programs is governed by separate program-specific fee schedules. New family Summer Camp rates are $1,400 per month or $3,000 for the full summer session. Returning family rates are $1,200 per month or $3,000 for the full summer session. These rates are subject to change per program year. 

3.8 Outstanding Balances 

The Academy reserves the right to withhold records, reports, or re-enrollment privileges until all outstanding balances are paid in full. Children may be temporarily suspended from attendance if an account balance remains unpaid for more than 30 days

4. Withdrawal and Termination

4.1 Parent-Initiated Withdrawal 

Parents wishing to withdraw their child from any program must provide a minimum of 30 days’ written notice to Academy administration. Tuition will continue to be owed during this 30-day notice period regardless of whether the child attends. Verbal notice is not sufficient. 

4.2 Withdrawal from Seasonal Programs 

Cancellation of enrollment in Summer Camp or Winter Camp must be submitted in writing. Cancellations made more than 30 days prior to the program start date will receive a refund of tuition paid, minus the registration fee and a $100 administrative processing fee. Cancellations made within 30 days of the program start date are non-refundable. 

4.3 Academy-Initiated Termination 

The Academy reserves the right to terminate enrollment at any time, with written notice, for reasons including but not limited to: 

  • Non-payment or chronic late payment of tuition or fees 
  • Falsification of enrollment documentation 
  • Behavior by a child that poses a risk to the safety or well-being of other children or staff, which cannot be adequately accommodated within the Academy’s standard programming 
  • Behavior by a parent or guardian that is disrespectful, threatening, or disruptive to staff or the Academy community 
  • Failure to comply with Academy policies, these Terms, or applicable Texas regulations 
  • Medical or care needs that exceed the Academy’s capacity to safely accommodate 

In cases where the Academy initiates termination, a prorated refund of prepaid tuition (minus any outstanding fees) will be provided for unused days beyond the notice period, at the Academy’s discretion. 

4.4 Emergency Termination 

In cases involving an immediate safety risk to children or staff, the Academy reserves the right to terminate enrollment immediately, without notice or refund. 

5. Daily Operations and Policies

5.1 Hours of Operation 

Program hours are communicated at enrollment and may be updated periodically. Parents are expected to adhere to drop-off and pick-up times. Specific program hours are provided in the enrollment packet. 

5.2 Late Pick-Up 

Children must be picked up by the scheduled end of the program day. A late pick-up fee of $1.00 per minute will be assessed for each minute beyond the program’s closing time. Chronic late pick-ups (three or more occurrences) may result in termination of enrollment. 

5.3 Authorized Pick-Up 

Children will only be released to adults listed as authorized on the enrollment form. Photo identification will be required of any individual not personally known to Academy staff. The Academy reserves the right to deny release of a child to any individual who cannot be verified, appears impaired, or raises safety concerns, and will contact emergency services if necessary. 

5.4 Custody and Legal Orders 

In the event of a custody dispute, the Academy must receive a current, certified copy of any applicable court order restricting pick-up rights. Without a court order on file, the Academy will follow its standard authorized pick-up policy. The Academy is not responsible for disputes arising from its compliance with this policy. 

5.5 Attendance and Absences 

Parents are asked to notify the Academy by 9:00 AM on any day their child will be absent. This allows staff to plan accordingly and ensures the Academy can verify all children are accounted for. 

5.6 Closures and Holidays 

The Academy observes select federal and state holidays and may close for staff professional development days. A schedule of closures is provided at the start of each enrollment year. The Academy will make reasonable efforts to provide advance notice of any unscheduled closure. No tuition credits are issued for scheduled closures. 

5.7 Inclement Weather 

In the event of severe weather or other emergencies, the Academy may delay opening, close early, or close entirely. Parents will be notified via the Academy’s parent communication app. Tuition credits are not issued for weather-related closures unless the closure exceeds five (5) consecutive business days. 

6. Health, Illness, and Medical Policies

6.1 Illness Exclusion Policy 

To protect the health of all children and staff, children who are ill may not attend. A child must be fever-free (below 100.4°F) and symptom-free for a minimum of 24 hours — without the use of fever-reducing medication — before returning to the Academy. This policy applies to vomiting, diarrhea, conjunctivitis, and other contagious conditions as well. 

6.2 Illness During the Day 

If a child becomes ill during the Academy day, parents or emergency contacts will be notified promptly and expected to pick up the child within one hour of notification. Children who are ill will be kept comfortable and supervised in a designated area separate from healthy children until pick-up. 

6.3 Immunization Requirements 

All children must meet Texas state immunization requirements prior to enrollment. Documentation must be provided before the child’s first day of attendance. Exemptions must comply with applicable Texas law and be documented accordingly. 

6.4 Medication Administration 

The Academy will administer prescription medication to a child only upon receipt of a completed, signed Medication Authorization Form and the medication in its original, labeled container. The Academy does not administer over-the-counter medication without written authorization from a parent and, where required, a healthcare provider. Staff are not permitted to administer medication outside these protocols. 

6.5 Allergies and Special Medical Needs 

Parents must disclose all known allergies, dietary restrictions, and medical conditions on the enrollment form and in a written care plan. The Academy will make reasonable accommodations for children with documented medical needs; however, the Academy cannot guarantee an allergen-free environment. Parents of children with life-threatening allergies must provide all necessary emergency medication (e.g., epinephrine auto-injectors) and a signed emergency action plan. 

6.6 Emergency Medical Treatment 

In the event of a medical emergency, the Academy will call 911 and administer first aid as appropriate. Parents will be contacted immediately. By enrolling their child, parents authorize the Academy to seek emergency medical treatment on their child’s behalf if a parent cannot be reached in time. Costs incurred for emergency medical services are the sole responsibility of the parent. 

6.7 Infectious Disease Reporting 

The Academy complies with all Texas Department of State Health Services requirements for reporting communicable diseases. In the event of a reportable illness in the Academy community, parents will be notified in accordance with applicable law and privacy regulations.

7. Child Safety and Security

7.1 Campus Security 

The Academy maintains a secured campus with restricted access. All visitors must be verified against approved access lists. The campus is monitored by 62 high-definition surveillance cameras covering interior and exterior areas, operating 24 hours a day, 7 days a week, with audio recording and continuous archiving. 

7.2 Camera Footage Requests 

Parents of currently enrolled children may submit a written request to review surveillance footage. Requests will be reviewed by administration and responded to within a reasonable timeframe. The Academy reserves the right to deny or limit footage access to protect the privacy of other children, staff, or to comply with applicable law. 

7.3 Staff Screening 

All Academy employees undergo comprehensive background screening prior to employment, including FBI fingerprinting, state criminal background checks, and reference verification. Staff receive ongoing training in child safety, emergency response, and child protection protocols. 

7.4 Staff-to-Child Ratios 

The Academy maintains staff-to-child ratios in compliance with Texas Health and Human Services childcare licensing requirements. Ratios are specific to each age group and are maintained throughout the program day. 

7.5 Supervision Standards 

Children are supervised by qualified staff at all times during the program day, including during outdoor play, meals, nap time, and transitions. No child will be left unsupervised at any time. 

7.6 Mandated Reporting 

All Academy staff are mandated reporters under Texas law. Any reasonable suspicion of child abuse or neglect — regardless of where it is believed to have occurred — will be reported to the Texas Department of Family and Protective Services (DFPS) and, where appropriate, local law enforcement. This obligation supersedes any parental request to the contrary. 

8. Behavior, Discipline, and Conduct

8.1 Discipline Philosophy 

The Academy uses positive guidance and developmentally appropriate discipline techniques. Discipline at the Academy is always constructive, never punitive, and never involves physical punishment, humiliation, or emotional harm of any kind. Staff redirect children using positive reinforcement, natural consequences, and age-appropriate explanations. 

8.2 Prohibited Discipline 

The following are strictly prohibited at the Academy, by any staff member or volunteer, under any circumstance: 

  • Corporal punishment of any kind 
  • Withholding food, water, or rest as punishment 
  • Confining a child in an enclosed space as punishment 
  • Verbal abuse, humiliation, or demeaning language 
  • Any discipline that causes physical or emotional harm 

8.3 Challenging Behavior 

For children demonstrating persistent challenging behavior, the Academy will communicate with parents and work collaboratively to develop strategies to support the child. If a child’s behavior poses a consistent risk to the safety of other children or staff, or requires one-on-one behavioral support beyond standard programming, the Academy may require a meeting to discuss the child’s continued enrollment. 

8.4 Parent Conduct 

Parents and guardians are expected to treat all Academy staff, other families, and children with respect. Threatening, abusive, or disruptive behavior by a parent on Academy grounds or directed at Academy staff — in person, by phone, or electronically — may result in immediate termination of enrollment. 

9. Curriculum, Programs, and Activities

9.1 Curriculum 

The Academy follows an EYFS-inspired curriculum enriched with STEAM learning, early literacy, phonics, mathematics, creative arts, music and movement, outdoor learning, and age-appropriate technology integration. Curriculum content and daily programming are at the professional discretion of the Academy and its educators. 

9.2 Language Exposure 

Children in Academy programs are introduced to English and Spanish through stories, songs, and age-appropriate activities. The Academy does not guarantee any specific level of language proficiency as an outcome of this instruction. 

9.3 Photographs and Media 

The Academy may take photographs and videos of children during the program day for the purpose of documenting learning, communicating with parents, and internal staff training. By enrolling your child, you grant the Academy permission to capture and share such media with your family through the Academy’s communication app. Parents who do not consent to any photography or media capture must notify the Academy in writing at the time of enrollment. 

9.4 Marketing Use of Media 

The Academy may wish to use photographs or videos of children on its website, social media channels, or marketing materials. This will only occur with separate, explicit written consent from the parent or guardian. Declining this consent will not affect enrollment or the quality of care provided. 

9.5 Field Trips and Off-Site Activities 

If the Academy conducts field trips or off-site activities, parents will be given advance written notice and required to sign a specific field trip permission form. General enrollment does not constitute consent for off-site activities. All field trips comply with Texas licensing requirements for transportation and supervision. 

9.6 Program Changes 

The Academy reserves the right to modify program content, scheduling, staff assignments, classroom arrangements, and operational procedures at any time. Parents will be given reasonable notice of material changes. 

10. Food, Nutrition, and Dietary Needs

10.1 Meals and Snacks 

The Academy provides scheduled nutritious snacks. For programs requiring lunch, families may be asked to send lunch from home or comply with specific guidelines, as communicated per classroom. Homemade, in-house meals are prepared by Academy kitchen staff and are designed to be healthy and age-appropriate. 

10.2 Dietary Accommodations 

The Academy will make reasonable efforts to accommodate documented dietary restrictions, allergies, and religious or cultural food preferences when communicated in writing at the time of enrollment. Documentation from a healthcare provider may be required for medical dietary restrictions. 

10.3 Food from Home 

Food brought from home must comply with Academy guidelines, which may prohibit certain allergens, foods with minimal nutritional value, or foods that present choking hazards. The Academy is not responsible for the nutritional content of food provided by families. 

 

11. Parent Communication and Partnership

11.1 Communication Channels 

The Academy communicates with families through its parent mobile application, direct verbal communication with classroom staff, written notices, and scheduled parent-teacher conferences held each term. Parents are responsible for maintaining a current, active profile in the Academy’s communication app and for reading all notices in a timely manner. 

11.2 Emergency Contact Information 

Parents must maintain current and accurate emergency contact information at all times. Updates must be submitted in writing to Academy administration promptly. The Academy is not liable for failure to reach parents due to outdated contact information. 

11.3 Parent Visits 

Parents are welcome to visit their child during the program day; however, visits must be scheduled in advance with administration to minimize disruption to the classroom. Open access via the CCTV app is available as outlined in the security section. 

11.4 Concerns and Complaints 

Parents with concerns about their child’s care, a staff member’s conduct, or any aspect of Academy operations are encouraged to first speak with the classroom teacher, then with Academy administration. The Academy is committed to addressing all concerns promptly and respectfully. Concerns may also be directed to the Texas Health and Human Services childcare licensing division. 

12. Privacy and Confidentiality

12.1 Child Records 

All child enrollment records, medical information, developmental assessments, and personal data are treated as confidential. Records will not be shared with third parties except as required by law, with the parent’s written consent, or as necessary for the child’s care and safety. 

12.2 Other Children’s Privacy 

Parents and family members may not photograph, film, or share identifying images or information of other children enrolled at the Academy without the express written consent of those children’s parents. Violation of this policy may result in termination of enrollment. 

12.3 Staff Privacy 

Parents agree not to solicit personal contact information from Academy staff, follow staff on personal social media, or contact staff through personal channels. All communications with staff should occur through the Academy’s official channels. 

12.4 Data Protection 

The Academy collects personal information from families for the purpose of enrollment, care, and communication. This information is stored securely and is not sold, rented, or disclosed to third parties for commercial purposes. The Academy complies with applicable Texas and federal laws regarding the protection of children’s personal information. 

13. Limitation of Liability and Indemnification

13.1 General Limitation of Liability 

To the fullest extent permitted by Texas law, the Academy’s total liability to any parent or enrollee for any claim arising out of or related to these Terms or the Academy’s services shall not exceed the total tuition paid by that family in the three (3) months immediately preceding the claim. 

13.2 Assumption of Inherent Risk 

Parents acknowledge that participation in early childhood programs, outdoor play, physical activities, seasonal camps, and STEAM activities involves inherent risks that cannot be entirely eliminated. By enrolling their child, parents voluntarily assume these inherent risks. 

13.3 Indemnification 

Parents agree to indemnify, defend, and hold harmless the Academy, its owners, directors, officers, employees, and agents from and against any and all claims, damages, losses, or expenses (including reasonable attorney’s fees) arising out of or related to: (a) any inaccuracy or omission in information provided by the parent to the Academy; (b) the parent’s violation of these Terms; (c) any third-party claim arising from the parent’s conduct; or (d) any pre-existing medical condition of the child not fully disclosed to the Academy. 

13.4 No Liability for Personal Property 

The Academy is not responsible for the loss, theft, or damage of personal property brought to the Academy by a child or parent. Families are discouraged from sending children with toys, electronics, jewelry, or items of significant monetary or sentimental value. 

14. Non-Discrimination Policy

Milestones Academy of Texas is committed to providing equal access to enrollment and services without regard to race, color, national origin, religion, sex, disability, or any other characteristic protected by applicable federal or Texas law. All families and children are welcomed and valued as members of the Academy community. 

15. Grievance and Dispute Resolution

15.1 Informal Resolution 

The Academy encourages all parties to attempt to resolve disputes informally through direct, respectful communication with Academy administration before pursuing any formal process. 

15.2 Governing Law 

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. 

15.3 Venue 

Any legal action arising out of or related to these Terms or the Academy’s services shall be brought exclusively in the state or federal courts located in Denton County, Texas. 

15.4 Waiver of Class Action 

To the fullest extent permitted by law, all claims must be brought in the parties’ individual capacity and not as a plaintiff or class member in any purported class action, collective action, or representative proceeding. 

16. Modifications to These Terms

The Academy reserves the right to amend these Terms at any time. Parents will be given a minimum of 30 days’ written notice of any material changes. Continued enrollment following the effective date of any amendment constitutes acceptance of the revised Terms. The most current version of these Terms will be made available at the Academy upon request. 

17. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed from the remainder of the Terms, and the remaining provisions shall continue in full force and effect. 

18. Entire Agreement

These Terms, together with the signed enrollment form, any applicable program-specific agreements, and the Academy’s current family handbook, constitute the entire agreement between the parties with respect to enrollment and the provision of Academy services. They supersede all prior or contemporaneous representations, understandings, negotiations, or agreements, whether oral or written. 

19. Acknowledgment

By signing the enrollment form or submitting a registration fee, the parent or legal guardian acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions in their entirety.
